Judge chides police for shielding parents who gave underage daughters to pastor for sex.

------As pastor is jailed for life for impregnating two underage sisters.

Justice Abiola Soladoye , the presiding judge of the Ikeja Sexual Offences and Domestic Violence Court had sentenced one 51-year-old pastor, Nduka Anyanwu, to life imprisonment for defiling and impregnating two teenage sisters. Anyanwu was arraigned on April 17, 2022, on two counts of defilement by the Lagos State Government.

Justice Sholadoye held that the three ingredients of defilement, were that the child was underage, the defendant had sexual intercourse with the victim and the consent of the child was not sought were established.

She said,” I am convinced of the evidence led that the defendant is guilty as charged for the offence of defilement

The Justice however chided the police for not arraigning the parents of the girls for thier role as the cause of the defilement despite the evidences that they masterminded the sexual offence against the minors.

“The police shied away from their responsibility by not charging the father of the victims along with the defendant.

“The parents of these victims are highly irresponsible and reckless in their parenting. The negligence of their children has contributed to them now being grandparents of two additional mouths to feed. They should have been sanctioned and brought to justice.

“The parents of these two victims, who are biological sisters, acted irresponsibly by allowing their so-called pastor friend to deceive them that he will help them take their children abroad when the defendant cannot even help himself.

“Nduka Anyawu, you are hereby sentenced to life imprisonment, in respect of count one and count two.

“The sentence is to run concurrently, his name should be registered in the Lagos State offenders’ register.”

A source stated that the police did not arraign the parents of the defiled girls as they have other children to cater for.

The source said ,, The police were considering the fact that the mother of these girls have eight children and it's was because she could not cater for all of them that she and her husband gave Thier children to the pastor. You need to see how the mother of these girls fought with the police in public when they went to arrest the fake pastor. She called him her inlaw because she couldn't feed her many children and the pastor used the opportunity to sexually molest the two girls. The police felt that if they arraign the parents, the other six underage children will have anyone to fend for them and they will be separated in different shelters,,

Reacting to allegations that the police would have collected a bribe to allow the parents to walk free, the source said ,, These are people who can't afford to feed themselves and Thier children. Which money do they have to give to the police,,

Reacting to the judgment, Mr Ebenezer Omiejalile the Coordinator, Advocates for Children And Vulnerable Persons Network ACVPN said " Congratulations to ACVPN ACVPN and it's No no sense vibrant partners.Mrs Dawodu the local Guidance and Counselling at the Oshodi Isolo local government Education Authority. Kudus to the Lagos State Ministry of Justice MOJ Alausa Ikeja for ensuring justice was duly served.

Even the judge observed lopsidedness where the root cause of the case was ignored, the very day this idiot was arrested the father and mother of both survivors assaulted the officer who tried to arrest the pastor.Weldon Iya Gani for seeing this case end to a logical conclusion, with this judgement it's minus one of a dangerous evil calculator fake Clergy men .Kudos to all Comrades from Agencies.ALWAYS REMEMBER FORGIVENESS IS A SIN"

It was gathered that Anyanwu defiled and impregnated the girls between 2019 and August 2020 at Arowojobe Street, in the Oshodi area of the state.

According to the prosecution, the offence is punishable under Section 137 of the Criminal Law of Lagos State 2015.

The defendant pleaded not guilty when he was arraigned, trial commenced and ended on October 11, 2022.

The prosecution called six witnesses, while the defendant testified as his sole witness.

When the matter came up on Tuesday for judgment, Olushola Shoneye announced his appearance for the state, but the defence was not represented.

During the trial, the first prosecution witness testified that though she is now 15-year-old, she was 13-year-old at the time incident happened.

She testified that the defendant was known to her as the pastor of their church and that he had been having sex with her and warned her not to tell anyone.

The victim stated that the defendant said she would not get pregnant, but she eventually got pregnant and had a child for the defendant.

The second prosecution witness, the older sister to PW1, now 19-year-old, but was 17-year-old, at the time of the incident, collaborated the first witness’ testimony that the defendant was their pastor.

She narrated how the defendant had sexual intercourse with her with the consent of her parents, that he would take her abroad for greener pastures, and she started visiting him.

A guardian and counsellor with Lagos State, Mrs Memunat Dawudu, who collaborated on the evidence of the victims, testified that she got to know about the matter on August 3, 2020, from the Oshodi Primary Health Centre.

The father of the victims, in his testimony, stated that he knew the defendant, as he was a church member, and also his friend that he was responsible for his two daughters’ pregnancies.

He said he was aware that the defendant was having sex with his daughters.

The mother of the victims, in her evidence, stated that she was shocked when she found out that her two daughters were impregnated by the same man.

Anyanwu, who testified, in his defence, said it was the father of the victims who gave him the second prosecution witness, as a wife and they were having conjugal relations.

While delivering judgment, the judge held that the prosecution was able to discharge the burden of proof placed on it, on the charge of defilement.

Naira notes scarcity: APC Governors el-Rufai, Matawalle, Bello sue Buhari,

As the scarcity of old and new Naira notes lingers, the Governors of Kaduna, Kogi and Zamfara States have sued the Federal Government at  the Supreme Court to seek an order restraining it (FG) and its agent-the Central Bank of Nigeria (CBN)- from implementing the naira redesign policy.

A report by PSN said that the three states filed the action through their Attorneys-General who averred that both the old and the new Naira notes were scarce, thereby affecting people, especially the poor.

The Plaintiffs in the suit are the three Attorneys-General and Commissioners for Justice while the Attorney-General of the Federation and Minister of Justice, Malam Abubakar Malami (SAN) is the sole Respondent.

Filing an ex-parte motion through their lawyer, Mr AbdulHakeem Uthman Mustapha (SAN), the states are urging the Supreme Court to grant them an interim injunction, stopping the Federal Government either by itself or acting through the CBN, the commercial banks or its agents from carrying out its plan of ending the timeframe within which the now older versions of the 200, 500 and 1000 denominations of the Naira may no longer be legal tender on February 10, 2023.

“Unless this Honourable Court intervenes, the Government and people of Kaduna, Kogi and Zamfara State will continue to go through a lot of hardship and would ultimately suffer great loss as a result of the insufficient and unreasonable time within which the Federal Government is embarking on the ongoing currency redesign policy,” Mustapha averred.

The states said there had been a shortage in the supply of the new naira notes in Kaduna, Kogi and Zamfara States and that citizens who had dutifully deposited their old naira notes had increasingly found it difficult and sometimes next to impossible to access new naira notes to go about their daily activities and transactions.

The states said the CBN policy was imposing a lot of hardship on Nigerians and insisted that the 10-day extension by the Federal Government was still insufficient to address the challenges of swapping their old Naira notes for new ones.

“That the majority of the indigenes of the Plaintiffs’ states who reside in the rural areas have been unable to exchange or deposit their old naira notes as there are no banks in the rural areas where the majority of the population of the states reside.

“Most people in rural areas of the Plaintiffs’ states do not have bank accounts and have so far been unable to deposit their life savings which are still in the old naira notes.

“There is restiveness amongst the people in the various states because of the hardship being suffered by the people, and the situation will sooner than later degenerate into the breakdown of law and order.

“The Plaintiff State Governments cannot stand by as they are duty-bound to protect citizens in their states and prevent the breakdown of law and order.

theconclaveng reports

“I know that if the Federal Government of Nigeria had given sufficient and reasonable time for the naira redesign policy, all the current hardship and loss being experienced by the Plaintiffs’ state governments as well as people in the various states would have been avoided,” the three states stated.

Court orders CP to arrest Fidelity bank MD, Secretary

A chief magistrate’s court in Ogba, Lagos

has ordered the Lagos state commissioner of police to arrest Onyeali-Ikpe the Managing Director of Fidelity Bank for disobeying a court order.

According to FIJ, the court, presided over by Magistrate Lateef Owolabi, extended the same sentence to Ezinwa Unuigboje, the bank’s secretary, after finding both guilty of disobeying a garnishee order of court restraining the bank from allowing a judgment debtor access to his account.

Owolabi had on December 6, 2022, issued the garnishee order for 17 banks to not grant Enabulele Ozaze, a judgement debtor, access to his bank accounts until he paid a judgement debt of N2.8 million.

Ozaze was on October 13, 2022, ordered to refund one Jibrin Ahmed the sum of N2.8 million. This sum was money Ahmed had earlier paid to Ozaze for the purchase of a Toyota Corolla car.

Two months after Ozaze failed to refund, Owolabi ordered 16 banks to not allow him transact on any account.

On January 25, 2023, Ahmed told the court, via an affidavit, that Fidelity Bank had flouted the garnishee order.

He showed the court how Ozaze had been withdrawing funds from his account. He claimed that Ozaze had N3,165,759.05k in his account with Fidelity Bank as of January 12, 2023, when the garnishee order was served.

Three days after the order was served, Ozaze withdrew N725,547.80k from the account. The following day, he transferred another N251,305.90 out of the bank.

On January 17, Obianuju Nwosu, Zenith Bank’s legal officer, confirmed they received the garnishee order on December 22, 2022, and apologised to the court for the transactions on the account.

On January 18, the court ordered that the managing director and the bank’s secretary to appear before it to explain why they should not be sentenced to prison.

Both were absent on Monday. Owolabi ordered their immediate remand and instructed the Lagos State Commissioner of Police to effect their arrest

The protesters had set tyres on fire on the major roads in Iwo road as they  urged  other residents to join them.
" One of the protesters who declined to give his name said " Are you not in this country? This government wants to kill us. Why will the banks hold on to our money and deny us access go it?How do they want us to feed, take transportation to work and fend for our families. Enough is enough. The government must reverse this naira swap.  It's obvious we are not ready for it".
Another resident Olarawaju Nathaniel said " I have been at the ATM since 6am. There has been long queues. It was same thing yesterday. The POS operators are charging N300 for every N1000 they give you. How do we cope? "

Visits around Sango, Bodija, UI and environs show that the banks in these vicinities are not dispensing cash from the ATM inspite of the crowd gathered to withdraw cash. The banks like Zenith, First bank, Access and others hurriedly shut thier doors to customers about 12 noon when news of the protesters approaching the city centre was  revealed.
A security man at Zenith bank at Bodija was seen turning back angry customers.
He said " We are closed for the day. Go back . Protest is not allowing the bank to load the new notes into the ATMs . When we heard that the protesters were heading to the banks, we had to hurriedly shut down and close for the day". .
An elderly man was seen pleading with the security man at the Zenith bank to allow him into the banking hall to no avail.
He said " I used the bank app to transfer some money. The money was debited from my account but the person did not get the money since last week. That is why I'm in the bank to complain but they are turning me back".

it was gathered that policemen in the metropolis were said to be on high alert to forestall any breakdown of law and order.
A business man at Dugbe area of the state said he escaped being manhandled by the angry protesters.
He said " I went to my business but I and other traders had to flee. The protesters were damaging things and beating people up . They went as far as shooting. They were about to hold me down to bear me up but I hurriedly locked my shop and fled".
